330 waterside workers have been struck down with asbestos disease and filed claims with the Stevedoring Industry Finance Commission. Of these 106 died or are dying of lung cancer, 59 from mesothelioma, 115 asbestosis and 41 asbestos related pleural disease. Worst affected areas are NSW, Victoria and WA.

Waterside workers are not directly affected by the Hardie scam. Even before the landmark Crimmins case in 2001 proved waterside employers were to blame for workers exposure to asbestos disease, the union fought and won agreement that compensation would be automatic. Previously the union negotiated a modest ex-gratia payment of around $70,000 each. This did not prevent victims taking further legal action. Now average payments can reach as much as $500,000. In most cases this is settled out of court.
